 Public Park bounded by Congress and
 Myrtle Avenues and Leavitt Street in
 the Third  Ward, Borough of  Queens

To The SUPREME COURT OF THE STATE OF NEW YORK:
                                The petition of JOHN M.
HACKETT and BANKERS TRUST COMPANY Executors of James R. Roosevelt,
deceased, by JOhn M HACKETT,as one of the Executors of the Estate
of James R.Roosevelt, deceased, respectfully shows to this Court
and alleges upon information and belief
                      
                  FIRST: That the Commissioners of Estimate
in the above mentioned proceeding were appointed by an order of
this Court duly filed in the office of the Clerk of the
County of Queens on the 7th day of November,1907.
 
                  Second: Thereafter, the Final Report of
said Commissioners as to Damage and Benefit was duly confirmed
by an order of this Court duly filed in the office of
the Clerk of the County of Queens on the 26th day of June,
1912.
 
                  Third: Title to all lands acquired in said
proceeding vested in the City of New York on the 26th day of June,
1912.
 
                  Fourth: That in the said Final Report an
award in the sum of Fifteen thousand and two hundred ( $15, 200.00)
Dollars was made to an " Unknown Owner" for land and improvements
taken by the City of New York in the above mentioned proceeding
described on the Damage Map and in the said Final Report as Damage
Parcels Nos. 1, 2, and 3.
 
                  Fifth: That on the 9th day of December,
1932, The Comptroller of the City of New York paid to the
