Referring to second paragraph my No. 386, November 24, as to who
would sign German Peace settlement I am offering herewith an
alysis that came to me which may prove of interest as follow
"One. according to democratic principles he who is in power governs
by the will of the people in the name of the and for the good of
the people.
Two. In a democratic regime he who governs can resign but he cannot
cede his power to others.
Three. Not even Parliament or Senate can deem itself authorized to
cede all rights and powers to a foreign authority. This would be
beyond and contrary to the constitution which in individual states
regualtes the exercise of powers within the state and does not
emplate the abdication of powers in favor of a foreign autho
