for that stock is $252 but investment counsel recommends
that the instructions stand for the time being.
 
            V. POLICY AS TO PUBLICATION OF F.D.R. LETTERS
 
       In January 1948 a memorandum was submitted to the Trustees 
outlining the legal rights of the estate in Mr. Roosevelt's
letters. It was there concluded that the Executors and
Trustees were left with no rights regarding the letters
given to the Franklin D. Roosevelt Library but that the
estate did retain the right to control publication of
letters which were not included in the gift to the
government - such as longhand letters and other letters of
which no copies were made or included in the files
transferred to the Government. This right to control
publication is a naked property right which does not depend
on any other considerations such as literary value or the
protection of the good name of the decedent and
irrespective of any asset or monetary value. This question
was never discussed with those in charge of the Franklin D.
Roosevelt Library but Mr. Herman Kahn, the director of the
Library, has independently come to the same conclusion.
 
       The question was squarely raised in connection with the
preparation of an article by Katherine E. Brand for the
Library of Congress publication "Quarterly Journal of
Current Acquisitions" on the papers of Josephus Daniels.
The Librarian of Congress requested the permission of the
Franklin D. Roosevelt Library to publish excerpts from
certain letters from F.D.R. to Mr. Daniels. Upon
examination of the files at the Library it was concluded
that certain of the letters were not among the papers given
to the Library and, consequently, permission to publish
those letters or
