BEING part of the same premises which James Roosevelt, deceased, acquired during his lifetime from Josiah W. Wheeler and wife by deed, dated May 16, 1867, and recorded on June 6, 1867 in the Clerk's Office of Dutchess County in Liber 140 of Deeds at page 329, and which lands the said James Roosevelt, deceased, under his last Will and Testament, recorded on December 22, 1900, in the Surrogate's Office of Dutchess County, in Liber 15 of Wills at page 303, devised to the said Sara Delano Roosevelt, for life, and the remainder thereof, in fee, to the said Franklin D. Roosevelt, and in which part the said Sara Delano Roosevelt granted and released her life estate to the said Franklin D. Roosevelt by deed of even date to be recorded herewith. The above-described lands are conveyed together with and subject to a right of way and easement at all times over, through and under that portion of adjoining other lands of the said Franklin D. Roosevelt and Sara Delano Roosevelt immediately west of the westerly line of the land hereinabove described and herein conveyed, the exact location of which right of way and easement is to be designated by the said Franklin D. Roosevelt, one of the parties of the first part, for the purpose of running off and discharging through proper channels or facilities any and all surface, |
