(2) That the Executors make such repairs to the Moses Smith
house and farm buildings as may be permitted by law prior
to the actual sale of the property to her.
(3) If the property along the Post Road is not sold as farm
property, that the Executors consider selling the farm
buildings to her as scrap to be used for salvage and repair
work elsewhere.
Mrs. Roosevelt also stated in that letter that she is
prepared to go though with the sale whenever the Surrogate
gives his approval.
III. Nisonger-Boos offer dated March 4, 1947.
Mr. Hackett and Mr. Koons conferred with Mrs. Nisonger, Mr.
Boos and their attorney Philip A. Myled at Mr. Hackett's
office on March 28, 1947 with respect to the offer to
purchase the approximately 420 acres of land along the
Albany Post Road and to the rear of the National Historic
Site for $100,000. As a result of this conference, it
developed that:
(1) The offer of $100,000 is for all practical purposes the
maximum amount which will be offered for the property.
(2) The offer of $100,000 is a gross offer subject to the
customary Dutchess County real estate brokers' commissions
of 7-1/2%.
(3) The principals in the transaction are John R Evans,
President of the First National Bank of Poughkeepsie,
Herbert Pell, Ex-Minister to Portugal and Hungary, and a
former friend of President Roosevelt, and William Victor
Ogley, a friend of the Roosevelt family and the
unsuccessful democratic candidate for Dutchess Country
assemblyman in the last election. The foregoing contemplate
the formation of a corporation in which others will be
invited to participate in the event the offer to purchase
should be accepted.
(4) The parties desire to purchase the property for the
purpose of promoting a high-class
