necessary to carry out and enjoy the right of way and
easement herein granted.
 
The lands hereinabove particularly described are granted and
conveyed subject to the following conditions and
restrictions which shall attach to, run with the land and
shall be binding upon the party of the second part and its
assigns:
 
FIRST, that at no time hereafter shall there be erected upon
the land herein conveyed any building or buildings of any
description, other than said library building and any
additions or improvements thereto, except such custodian's
or gate keeper's dwelling or control post at or along the
easterly line of the land herein conveyed as may be deemed
necessary or desirable by the party of the second part;
 
SECONDLY, that at no time hereafter shall any tree or trees
hereby conveyed and presently abutting the west side of the
New York and Albany Post Road bounding the easterly line of
the herein granted premises, be removed or cut down and
that any of such trees as may fall or accidentally be
destroyed shall be forthwith replaced.
 
Together with the appurtenances, and all the estate and
rights of the parties of the first part in and to said
premises.
 
TO HAVE AND TO HOLD, the premises herein granted unto the
party of the second part, and its assigns, forever,
subject, however, to the trust as
